China court sentences one to death, one to life in prison in fund-raising scam 2010-12-31 A court in east China's Jiangsu Province sentenced a man to death and another to life in prison Friday for illegally raising up to 4 billion yuan (606 million U.S. dollars) in a fraudulent investment scheme. Another 11 suspects were given jail terms ranging from two-and-a-half to 10 years for collusion in the fraud, which caused losses of 650 million yuan (98 million dollars) to 14,822 investors, the Intermediate People's Court in the provincial capital, Nanjing, said in a statement. According to the statement, Sun Haiyu and Hu Zhen jointly set up a company, Nanjing Runzai Biology Co., Ltd. in January 2004 and began soliciting investments from the public in the name of planting glossy ganoderma, or reishi mushrooms, which are widely used in traditional Chinese medicine. The judge said the company exaggerated its profits in planting glossy ganoderma and fraudulently claimed that the investment was risk free. The duo, together with 11 accomplices, raised more than 4 billion yuan from April 2004 to July 2008. Sun was sentenced to death for the crime of illegal fund-raising by fraudulent means, while Hu was sentenced to life imprisonment. |

China penalizes property developer for pushing up housing prices 2011-03-28 The price authority of a southeastern city had imposed a penalty on a land developer for improperly pushing up housing prices, according to a statement released Monday by China's National Development and Reform Commission (NDRC). The price bureau of Ganzhou City in Jiangxi Province found that the Jiangxi Yunxing Real Estate Co. had deceived consumers by disseminating rumors about future home price increases, according to the statement. "The next stage of our housing project will be available in the first half of 2011 at the earliest, and prices are very likely to exceed 8,000 yuan a square meter," the company said in a notice to potential home buyers last December. Ganzhou's price bureau imposed a fine of 500,000 yuan on the company and ordered the repayment of all money collected from potential buyers, in accordance with the country's Price Law. The NDRC said that this case should serve as a warning for property developers to ensure strict adherence to the laws and regulations on pricing. The NDRC announced new regulations last week that ordered property developers to clearly post their prices and sell homes at the marked prices starting from May 1. The regulations aim to address public complaints about the lack of transparency in home pricing. |

Chinese tycoon Huang gets 14 years in prison 2010-05-19 A Beijing court Tuesday morning sentenced Huang Guangyu, former chairman of Gome Electrical Appliances Holdings, to 14 years in prison for illegal business dealings, insider trading and corporate bribery. Huang, once China's richest person, was also fined 600 million yuan ($88 million), with another 200 million yuan worth of property being confiscated, the Xinhua News Agency said. Huang, 41, was detained in November 2008 for investigation of stock market manipulation allegations. He made his fortune by founding and building up Gome, now China's second largest home appliance retailer by market value. He was ranked as mainland's richest person by Hurun's China Rich List from 2005 to 2008, with assets reached 43 billion yuan ($6.3 billion). Du Juan, Huang's wife, was sentenced to three-and-half years for insider trading and fined 200 million yuan. Huang's two firms, Gome and Beijing Pengrun Real Estate Development Company, were fined 5 million yuan ($735,000) and 1.2 million yuan respectively for giving bribes, the statement of Beijing No. 2 Intermediate People's Court said. As the major shareholder of Beijing Centergate, Huang was found guilty of insider trading of the company's stocks in 2007, with a total value of more than 1.415 billion yuan. The dealings, from April to September, earned him more than 309 million yuan in illicit profits. These dealings earned Huang more than 309 million yuan in trading profits. Huang was found to be liable for the bribes given by the two companies as he was personally involved or directed others to do so, said the court. He directly bribed or instigated others to bribe five government officials with 4.56 million yuan in cash and properties from 2006 to 2008 in exchange for corporate benefits, the indictment said. Xiang Huaizhu, former deputy director of the economic crime investigation bureau of the Ministry of Public Security, stood trial in March on charges of accepting bribes of 1.06 million yuan to fix cases concerning Huang's companies. Huang was also convicted of corporate bribery for asking Xu Zhongmin, former chairman of Beijing Centergate, to bribe police and taxation officials in whose cases no verdict has been announced. Xu was sentenced to three years and fined 100 million yuan Sun Haiting, a senior official with the State Administration of Taxation's inspection bureau, allegedly accepted 1 million yuan, and two Beijing taxation officials 500,000 yuan each. Jin Hongli, a police official from the economic investigation division of the Beijing municipal public security bureau, received 1.5 million yuan from Xu, the indictment said. A number of other police officials, including Zheng Shaodong, former assistant minister of public security, have also been investigated for accepting bribes from Huang. Former chairman of the Hong Kong-listed Gome, Huang was born into a poor family in Fenghu village, Shantou, Guangdong province. He was also convicted of illegally trading 822 million Hong Kong dollars from September to November 2007. The statement said the court found Huang's crimes to be extremely serious, but showed leniency because he had admitted guilt and assisted with the criminal investigation. Yang Zhaodong, one of Huang's defense lawyers, told reporters soon after the verdict that Huang was "calm" upon hearing the sentence, but his family, including his mother and two sisters, turned very emotional. Gome shares closed up less than 1 percent on Tuesday at HK$2.32 after the sentencing was announced. Gome Group, issued a statement on Tuesday, saying it respects the verdict. "With the case coming to an end and the company's restructuring complete, Gome Group, with abundant capital and stable structure, will focus on its operations," the statement said. |

Shenzhen mayor formally sacked for taking bribes
2010-08-18 Xu Zongheng has been formally sacked as mayor of south China's Shenzhen City for taking bribes and other abuses, the Communist Party of China (CPC)'s disciplinary watchdog said Wednesday. Xu was removed from his official post and stripped of his CPC membership for "severe violation of disciplines and the law," said a statement from the CPC Central Commission for Discipline Inspection (CCDI). A CCDI investigation found Xu had abused his office to make profits for others, accepted large amounts of money in return, and led a "corrupt life," said the statement. Xu, 55, who became mayor of Shenzhen in 2005, was stripped of his post as deputy to the National People's Congress, the national legislature, in August last year. |

High-ranking inspector convicted
Updated: 2010-05-21 BEIJING - Guo Jingyi, a former high-ranking inspector of the treaty and law department of the Ministry of Commerce, was sentenced to death with a two-year reprieve on Thursday for accepting 8.45 million yuan ($1.24 million) in bribes. Guo Jingyi, a former highranking inspector of the treaty and law department of the Ministry of Commerce. The sentence means Guo's behavior in prison will be assessed for two years, following which he will have a chance to appeal for leniency. In China, death sentences with reprieves are usually commuted to life imprisonment. The Beijing No 2 Intermediate People's Court also ordered all of Guo's personal property to be confiscated. As a department chief-level inspector, Guo is the ministry's highest ranking official to have been convicted since its founding in 2003. The court agreed that the bribes Guo received included about 4.4 million yuan, $250,000, HK$220,000 ($28,197) and also a profit of about 1.6 million yuan from purchasing property at far below the market rate. According to the procuratorate, from 2004 to 2007 Guo accepted bribes twice, totaling 1.1 million yuan, from home appliance giant Gome Group to help it transfer equity and pass an anti-monopoly inspection. Huang Guangyu, former chairman of Gome Group and once China's richest man, was sentence on Tuesday to 14 years in jail for illegal business dealings, insider trading and corporate bribery. The investigation of Huang's case exposed a number of high-ranking officials and Guo is the first among them to have been tried. The indictment also said that in 2002 Guo, as vice-director of the treaty and law department of the then Ministry of Foreign Trade and Economic Cooperation, together with Liu Wei, a former official from the State Administration for Industry and Commerce, helped a real estate company under Beijing Capital Group establish a company with foreign funds. Guo later bought a villa from the company at half its market price and made a profit on it of about 1.2 million yuan. In 2005, Guo and Xu Gangman, a former official in the State Administration of Foreign Exchange, helped a company to avoid punishment for illegal currency exchange and together accepted bribes of about 3.9 million yuan. Guo was further charged with accepting bribes of 780,000 yuan from Zhang Yudong, a college classmate who was a partner in a law firm, by helping Zhang acquire cases. With Zhang's assistance, Guo illegally profited from buying property below its market value. Liu, Xu, and Zhang have all been detained and investigated. Guo, 44, graduated from the law school of Peking University in 1986. After graduation he worked in the then Ministry of Foreign Trade and Economic Cooperation, which was later renamed the Ministry of Commerce, and had an impressive career, until he became the inspector of the department of treaty and law in 2008. On Aug 13, 2008, Guo, at what turned out to be the pinnacle of his career, was suddenly removed from his post and held for investigation. |
